Roundtable - Competition Law and New Challenges to Industry

Mumbai, 14th November, 2014, The Public Affairs Forum of India (PAFI) organized a roundtable in Mumbai on the topic of "Competition Law and New Challenges to Industry" with J. Sagar Associates (JSA) as its Knowledge Partner. The session provided an interactive platform for regulators and industry representatives, to come together and deliberate on the emerging challenges.

Justice B. N. Srikrishna, Former Judge, Supreme Court of India - in his introductory address - highlighted the need for effective coordination & cooperation between regulators like Competition Commission of India, SEBI and the RBI. He emphasized that regulatory action should be contextual and in accordance with the objects of the legislation. He also spoke about the interplay between Competition Law & Intellectual Property Rights, and the need for regulators to be consistent and predictable while implementing statutory objects.

Mr. Ashok Chawla, Chairperson, Competition Commission of India (CCI), - in his key note address - gave the audience a perspective on the CCI's efforts at advocacy as well as enforcing the Competition Act. He spoke about responsibility the industry has, to promote fair competition, and the challenges CCI faces in enforcement of the law on account of various litigation in courts. Explaining the penalties levied are wrongly perceived as harsh and arbitrary, the regime is however business-friendly as can be seen from quick approvals given in merger cases.

The panel discussion included Mr. L. Raja Sekhar Reddy, Director General, Competition Commission of India; Mr. Rajesh Bagga, Group General Counsel, Reliance ADAG; Mr. Santosh Parab, General Counsel, IDFC Limited; Mr. Amitabh Kumar, Partner, JSA; and with Mr. Rajeev Batra, President - PAFI & the Group Head–Corporate Affairs, Hindustan Unilever Limited as the moderator. The discussion reiterated the need for advocacy and importance of Competition Law, in making the industry more ethical and fair, and the challenges in terms of heavy penalties, as well as procedural uncertainties the industry faces in the practical application of the law

Speaking on the occasion, Mr. Amitabh Kumar, Partner, J. Sagar Associates said, "Today there is an urgent need to build robust procedures & processes, devoid of ambiguity, to ensure smooth business operations and fair trade practices. An interactive platform such as this, between industry representatives across sectors with the CCI for the cause of competition advocacy will serve the industry well. The role of the Chairman, CCI in promoting awareness is commendable."
